PELTIER: FLORIDA & MONEY TRAIN

Dear Supporters:

A November 11th communiqué from Peltier/ILPDC revealed some interesting details and potential conflicts as they have established their new “National Office here in Tampa, FL.”

Apparently, the November 6th Tulsa concert didn’t meet expectations. According to the ILPDC they “didn’t raise as much money as we had hoped.”  (Yet, did anyone catch the November 10th ILPDC press release entitled, “The Concert was a Wonderful Success.” Mixed messaging is a Peltier staple.)

The NPPA has been informed that the concert was poorly attended and probably lost money. There were approximately 1900 seats available and less than half were filled. There was very little fundraising activity at the venue. Aside from the poor timing of the event (months from now no one will even remember) it is just another indication that Peltier’s notoriety continues to slip away.

The concert begs the question; just how much did they raise?  Though the amount raised was not disclosed; where it allegedly went was. According to the ILPDC “The money raised went directly into Leonard Legal Trust account.” (Which is odd that it isn’t the Leonard Peltier account. But perhaps that was just a typo or oversight.) However, this bears the markings of an oxymoron; it is remarkable that a convicted felon/inmate is having money from various sources funneled into a “legal trust.”

Solicitations for donations of checks, money orders, PayPal and purchasing Peltier’s artwork continues in earnest, which raises again some curious questions.

It certainly sounds like there’s a business being run, at Peltier’s direction and on his behalf, from the ILPDC National Office at 116 W. Osborne Ave., Tampa, FL 33603

Nevertheless, the Florida Solicitation of Contributions Act (FSCA) regulates solicitation of public contributions and requires full disclosure of certain information from persons soliciting contributions in Florida.

The FSCA requires anyone who solicits donations from people in the State of Florida to register with the department and renew annually. The department collects registration fees and has authority to impose penalties for non-compliance.

Are Leonard Peltier and his International Leonard Peltier Defense Committee complying with Florida laws as they fund the Leonard Legal Trust account?

The City of Tampa has certain business operating requirements and states that it is unlawful for any person to engage in a regulated business without a current business-operating permit. And, in fact, each day of operation without a permit constitutes a separate offense. The city goes on to require that any person who shall commence operation of a regulated business before obtaining a business operating permit shall pay double the application fee prescribed for that business. The payment of the double fee shall not preclude, nor be deemed a substitute for prosecution, as provided for elsewhere in the city code.

Peltier’s ILPDC is located in a single-family residence in Tampa. There are likely zoning requirements regarding potentially operating a business from a single-family residence.

Are Leonard Peltier and his International Leonard Peltier Defense Committee conforming to the City of Tampa (and Hillsboro County) business and zoning regulations? That remains to be seen.

P.S.
1) In November Peltier sent yet another rambling message filled with characteristically disjoined claptrap and rhetoric.  For the benefit of diehard Peltierites who are unable or incapable of seeing through the fog of Peltier myth, folklore and fabrications and to help connect the—dots—regarding the hypocrisy of the money train, he publicly provides us with this little gem:

“The air, the water, the soil, all of nature is screaming against the injustice that is continually perpetrated by those who worship money…and Peltier continues with…If you have any questions about donations for my new legal team please call our new office in Tampa, FL.” (Leonard Peltier, November 23, 2017)

From Peltier’s lips to God’s ears.

Actually, from a convicted double-murderer’s lips to the Creator’s ears.

A time will be here, one day, when Peltier will face the Creator and mumble his truth about what actually happened at Jumping Bull, and Jack and Ron will be watching.

2) Curiously, on 11/20/17 a Florida corporate filing was rejected. The reason is not clear but the filing was for the International Leonard Peltier Defense Offense Committee. Oddly though that the Peltier website clearly lists it as the Leonard Peltier Defense Committee. Offensive as much of the material on the Peltier website may be, is this just another example of the mixed messaging from the Peltier camp?

PELTIER: MEMORIAL SERVICE

Dear Supporters:

No, this is not about a memorial service for the unrepentant convicted double murderer Leonard Peltier.

Each year FBI offices hold a memorial service for Special Agents killed in the line of duty as a result of adversarial action, Special Agents and FBI employees who died as a result of performing law enforcement duties, and to recognize law enforcement line-of-duty deaths from around the country.*

A memorial was held on May 22nd at the FBI’s Cincinnati office. The non-denominational service was conducted by the long-time FBI Chaplin.

The Special Agent in Charge presented a list of the biographies of FBI personnel recently added to the list. Several of these deaths were the result of terminal illnesses caused by extended periods of exposure to the toxic environments in Shanksville, PA, the Pentagon and the World Trade Center in the aftermath of the September 11th terrorists’ attacks.

Every service includes a reading of the names of Agents killed in the line of duty—now at thirty-six—as a result of adversarial action.**

The list begins with SA Edwin C. Shanahan, shot and killed in October 1925 by a car thief and ends with SA Samuel Hicks, shot and killed in November 2008 during an arrest involving a major drug trafficking organization.

From Special Agents’ Shanahan to Hicks, all the cases have long been resolved and closed with the subjects’ either killed during the commission of the crime, or with those that did survive until now, serving long prison sentences.

However, two on the list—#21, Jack R. Coler, and #22, Ronald A Williams—long after their brutal murders, have had their memory and sacrifice denigrated for the past forty-one years. Theirs is the one case that is still very much with us as Leonard Peltier and his dwindling network of sycophantic followers have neither the intelligence nor courage to challenge the lies and fabrications Peltier has been peddling since June 26, 1975.

The Peltier network is dead in the water. The Peltier website has become stagnant, and Peltier is undoubtedly still mumbling to himself, in shock, since President Obama saw through the lies, fabrications, myth and folklore. The President undoubtedly understood the facts and Peltier’s unquestioned guilt.
Thank you President Obama.***

Uncharacteristically, Peltier, the self-created public figure, has remained silent, perhaps finally learning that with each public statement and “press release” he only succeeded in placing a prison sneaker firmly in his own mouth. Or, still bewildered by the January 18th denial of clemency, remains speechless.

PELTIER: NPPA 17TH ANNIVERSARY

Dear Supporters:

On April 30th the No Parole Peltier Association reached its seventeenth anniversary.

Since its inception in 2000 the NPPA has covered a lot of ground, particularly in destroying the fabrications, myth and folklore surrounding Leonard Peltier. Those efforts were, and are, based on public court records, transcripts, books Peltier authored or co-authored, recorded press interviews, a film in which Peltier appears, statements by co-defendants and press releases and statements made by Peltier himself as he has reinforced his own guilt while promoting himself as a public figure.

The NPPA’s founding principle remains to honor the memory and sacrifice of FBI Agents Jack Coler and Ronald Williams.

Parole is a very distant hope since the 2009 Lewisburg parole hearing. The next scheduled hearing is 2024.*

Except for June 26, 1975, January 18, 2017 arguably marked the most significant date in the Peltier narrative; President Obama denied Peltier’s clemency petition. (Thank you, President Obama. **)

The obvious conclusion was that the Attorney General, Pardon Attorney and the President all agreed that Peltier should continue to serve the remainder of his lawful conviction and consecutive life sentences.

As a reminder to all that Peltier remains an unrepentant cowardly convicted murderer: ***

“And really, if necessary, I’d do it all over again because it was the right thing to do.”

PELTIER: FARGO & JIHAD JANE

Dear Supporters:

Peltier is still reeling from the devastation of January 18th and the realization that he’s not going anywhere, at least for the next four years. (Thank you, President Obama.*)

The International Leonard Peltier Defense Committee (ILPDC) announced that it has reorganized (for about the fifth time since 2000), under new leadership and has moved back to Fargo.

Fargo, where it all began for Peltier after his trial and sentencing on June 2, 1977 to consecutive life sentences for the brutal murders of FBI Agents Jack Coler and Ron Williams.

The ILPDC bulletin, on an inartfully named website, powwow-power.com, announced that Peltier’s niece, Kari Ann Boushee and cousin, Paulette Dauteuil-Robideau, will be heading up the new office. Likely a desk and computer in someone’s basement.

The cousin part is interesting carrying the hyphenated -Robideau. Bob Robideau, the now deceased low-life who participated in the cowardly attack on the Agents and among other things claimed in an email that “they died like worms,” was according to Peltier, his cousin. If Paulette married a Robideau, or perhaps even this particular reprobate, how does that make her Peltier’s cousin? A cousin by marriage?

Not exactly tolerant or sensitive of other religions or ethnicities, the home page for the ILPDC announcement was advertising “Olive Drab INFIDEL T-shirts.”

Dauteuil makes no excuses for her radical and communist affiliations, boastful even of her association with every sort of left wing, anti-establishment and un-American cause one could imagine. Her résumé, proudly posted on the Jericho Movement’s national website includes references to comrades, revolutionary change, and peoples struggles. Listed on this website is the Jericho Movement’s email address, jihadabdulmumit@gmail.com. Perhaps a sobriquet for Ms. Dauteuil could appropriately be, Jihad Jane.

In 2005, this writer attended a Jericho Movement meeting in New York City to listen to Bob Robideau make a fool out of himself in front of a relatively politically astute but radically unhinged group. It was a rather small gathering (considering the population of Manhattan) of pathetic leftist radicals that so hate Amerika (with a K) that it makes one wonder if they despise America so much, why don’t they just leave? That’s a rhetorical question, of course, because they know anywhere else they wouldn’t have the freedom to be as vile as they please.**

As a postscript of sorts, remember, too, that Robideau himself castigated Peltier and left the committee with a public pronouncement of his disgust for Peltier’s abhorrent and deviant prison behavior.

Ms. Boushee and Jihad Jane advise they are “…also putting together a new legal team, working board, fundraising and Art sections as well as International and National Chapter leadership positions.”

Translation: Peltier’s fortunes have collapsed. The uninformed and misguided diehards are discouraged, oozing away to find some other false prophet to swoon over, along with the leaches who sucked onto the Peltier myth for their own benefit. Peltier has no idea, or is perhaps unwilling to admit that so many people over the years have been using him for their own personal gain or fifteen minutes of fame. That includes a gaggle of attorneys looking for some notoriety or a few that could care less that Peltier is actually guilty,*** and the worst kind, the wannabes, those non-natives who adopt Indian sounding names and assume they have something meaningful to offer.

No, this will be nothing more than a weak and failed attempt to reinvigorate or reinvent the cash cow.

We have yet to hear from Peltier himself and those first utterances will likely be the same shallow whining we’ve heard for many years. Man up Peltier, you made your decisions that fateful day, acted on them, made your bed, now lay in it.

Peltier has to face the reality of his criminal acts and recognize that his days in the sun are over.*^

PELTIER: FETAL POSITION

Dear Supporters:

The Peltier website, www.whoisleonardpeltier.info* hasn’t been updated since President Obama denied Peltier’s clemency petition on January 18th.

It appears to be frozen in time with the latest posts as meaningless as Peltier’s claims of innocence, not to mention the perversity of his view that his conviction represented his people.

--On the home page there’s a link to 8th Circuit Court, Judge Gerald Heaney’s letter.
A letter long debated but clearly not an endorsement of Peltier’s innocence, actually quite the contrary. [i]

--Statement by former FBI Agent and Congressman Don Edwards:  This clearly demonstrates the desperation of the Peltier network. Edwards’ letter is dated December 21, 2000 and was the subject of a critical NPPA rebuttal. [ii]

--Letter by former U.S. Attorney James Reynolds: Reynolds called for clemency and erroneously claimed he had management and supervision over the Peltier conviction. (Mr. Reynolds should be publicly challenged about his assertions, but at this point, it doesn’t matter.) [iii]

--Letter by former FBI agent John Ryan. Disgraced and dismissed, Ryan’s opinion on Peltier is of no consequence.

Further on in the Peltier website there are links to:

--Russ Redner, Thanks for nothing, Obama: Which is rich because Redner, at times, was more of a hindrance than a help to Peltier and was responsible for one of the most ignorant and reprehensible public statements regarding the deaths of Special Agents Jack Coler and Ron Williams.  Peltier publically also brought to light Redner’s “severe emotional and mental problems.” [iv]

--Celebs react to Obama denying clemency to Leonard Peltier: Really? Who cares or gives a rats-whatever what the Hollyweird crowd thinks. Overpaid egotists should stick to what they do best (sometimes anyway), pretending to be someone else.

This is followed by a longer list of the same old plaintive cries of a wrongful conviction completely unmoored from the facts of June 26, 1975 and Peltier’s conviction and many subsequent appeals. Appeals that only reinforced the validity of his rightful conviction and unquestioned guilt. Guilt only toughened by Peltier’s many public admissions. [v]

But not a word from Peltier.

The last time Peltier believed commutation was imminent, but wasn’t, he fired off his famous “politicians are such sleazebags” comment during a public interview about President Clinton.[vi]  We’re likewise patiently waiting for a similar attack on former President Obama. [vii]

But now inmate #89637-132 must be in a state of bewildered disbelief, sucking his thumb and curled up in a fetal position in the corner of his USP Coleman cell, knowing full well that he’s not going anywhere during this law and order administration.

Peltier does still have the statutory opportunity for parole review hearings, this year and in 2019. Years’ past he has waived the hearings but the sense now is that he’ll at least take a crack at this one. What else does he have? These hearings are administrative in nature to address any mitigating circumstances concerning his sentence and incarceration. Since Peltier remains totally unrepentant, that part is a nonstarter. He does, however, try to make as much noise as possible about his health. Too bad for that, since he robbed Jack Coler and Ron Williams of their opportunity to have a full life and face the predicable aging process.

But we will be watching whether or not Peltier does have a review hearing, now or at any time in the future. [viii]

Nevertheless, there is one bright spot for Peltier. The U.S. Bureau of prisons has hospital facilities.

*The NPPA never hesitated to publicize Peltier’s website. It has been on the NPPA homepage since April 2000.

Postscript:
Now that the Peltier saga has all but come to an end it was time to consolidate the many documents and reference materials and reorganize my study for a long-planned project. In the basement are several storage boxes of Peltier material and four file cabinet drawers in my study that accumulated over the past few years. These were reviewed, duplicates or unnecessary material was discarded, and what remained was placed in another plastic storage bin to join the rest—never to be destroyed, but available, if needed, for historical reference, along with the NPPA website. The next personal project will not be about Leonard Peltier, but another equally important FBI case. Nearly seventeen years of Peltier is about enough. Yet some things will remain. Found among the many documents, blogs, Editorial essay research material, etc., was a simple black and white flyer that brought back an incredibly strong and fond memory—a handout that was given to all who attended the dignified procession to the White House on December 15, 2000 as a show of solidarity against any consideration by then President Clinton not to grant Peltier commutation. Also, not in storage, but on the top shelf of my study in front of the folded flag for the past sixteen years, is a photo in front of the White House of four very proud FBI agents on that cool, crisp winter day. One, who came up with the idea and led the organizing effort; her future husband assisting her; an agent who was very close to Ron Williams and worked the RESMURS case to the end; and a pushy New Yorker who recognized that a torch needed to be lit to honor the sacrifice of two young agents killed in the line of duty and to counter the lies and fabrications from their murderer. It was an incredibly meaningful experience for all who attended and we still owe a debt of gratitude to all those who made that day so significant.

(Leonard Peltier had a recurring dream, especially approaching mid-January, that he could finally see light at the end of the tunnel. It was a freight train.)
“They (FBI and BIA) did not arrive in time to prevent the Oglala Akicitas and their allies from counting coup on them.” (Russ Redner, 2005)
In an October 14, 2005 statement Peltier excoriates the government and nearly everyone else as he also mentions the efforts of Russ Redner, his new LPDC director, who had (only) recently returned to the Peltier camp. But this is how Peltier rewards loyalty when apparently Russ Redner runs into personal difficulties:
"Due to severe emotional and mental problems Russ has submitted his resignation as Director of the LPDC. I have accepted his resignation and ask everyone to pray to Wankan Taka or his Allah to restore his mental health, so that he won't have to be hospitalized."
--Another thoroughly disgusting statement came from low-life, AIM co-defendant, now deceased, Bob Robideau, who penned an email stating “they died like worms.”

                                                                                                                   Parole opposition

Dear Chairman Wilson-Smoot:

We respectfully submit the following, particularly Peltier’s public admissions as late as 2016, as justification for denying parole consideration.

Briefly, Peltier was convicted for the brutal murder and aiding and abetting in the murder of FBI Agents Jack Coler and Ronald Williams on the Pine Ridge Indian Reservation on June 26, 1975. He received consecutive life sentences plus an additional seven consecutive years for an armed escape from USP Lompoc in 1979.  Also, due to a number of prison infractions Peltier has served a total of over five years in solitary confinement.

Peltier’s case has received numerous judicial reviews, twice reaching the U.S. Supreme Court. His conviction and sentence has never been altered.

Peltier has maintained his innocence, claiming to be a political prisoner, and has been supported by a number of celebrities. However, his version of the killing of the agents has changed numerous times over the years and his public statements (set forth below) belie his innocence.

On July 28, 2009 Peltier was afforded a full parole hearing, at which I was one of the witnesses.

Peltier’s parole was denied and extended for fifteen years to 2024. However, under the sentencing guidelines he is afforded biennial interim parole review hearings that may occur this year and in 2019.

Of critical importance is for the Commission to be fully aware of Peltier’s public admissions since his last parole hearing:

In 2010 Peltier stated, “And really, if necessary. I’d do it all over again because it was the right thing to do.”

In 2014 Peltier stated, “I don’t regret any of this for a minute.”

On February 17, 2016, Peltier submitted a petition for executive clemency. His attorneys, Martin Garbus, Cynthia Dunne and Carl Nadler made this document public on the Internet. President Obama denied the petition on January 18th.

The petition is replete with factual errors and relies heavily on long disproven claims by Peltier as he has proffered a never-ending stream of myth and folklore surrounding the events of June 26, 1975 and beyond.

Of critical note for parole consideration is on page three of this document under the heading of “Remorse” where Peltier makes yet another admission of guilt:

“I did not wake up on June 26 planning to injure or shoot federal agents, and did not gain anything from participating in the incident.”

Prior to, and since the 2009 parole hearing, Leonard Peltier remains the unrepentant and remorseless cold-blooded executioner of two federal agents he and others had already attacked and severely wounded. Agent Coler, nearly fatally wounded, was believed to be unconscious from a devastating wound before he was shot twice in the face. Agent Williams, however, was alive and had a defensive wound to his hand before he too was shot in the face, killing him instantly.

Peltier will undoubtedly claim he should be paroled because of health issues. The Bureau of Prisons has medical facilities to address inmate aging and health concerns. However, Jack and Ron, because of Peltier’s criminal actions, never had the opportunity to live a full life and face the inevitable aging process. Peltier robbed them of that possibility.

Leonard Peltier should be shown as much consideration and compassion as he gave Agents’ Coler and Williams, which would be none.

We respectfully request that in view of Peltier’s public admissions and lack of remorse he should not be considered for parole at any time.

Sincerely,

Edward Woods

PELTIER: THANK YOU PRESIDENT OBAMA

DEAR PRESIDENT OBAMA

If I may take the liberty to not only speak for myself (former Green Beret and 30-year FBI Agent), but on behalf of all the men and women, past, present and future, who wear the uniform or carried the badge and willingly placed themselves in harms way to serve and protect the lives and property of everyone in this great nation.

We are collectively grateful, and humbled, that you chose not to grant commutation to Leonard Peltier. His brutal attack and murder of two young FBI Agents and his remorseless public statements support that justice should continue as he serves the remainder of his lawful conviction and sentence.

May your post-Presidency years, shared with your family, be rewarding and productive.

“In the Spirit of Coler and Williams”
Ed Woods[i]

[i] To all those who have supported the NPPA and helped champion the cause for justice over the past nearly seventeen years, thank you. Jack Coler and Ron Williams, no doubt, are looking down with gratitude. As the final chapter in the long saga of June 26, 1975 comes to an end, solace can be found in that justice has been served. Little more need be said and the periodic blogs and updates will undoubtedly end, but the No Parole Peltier Association website will remain as an Internet resource for those who are at least concerned about learning the facts and truth.

PELTIER: NPPA INTERVIEW, PART 1

Dear Supporters:

The No Parole Peltier Association was recently contacted by a reporter from South Dakota Public Broadcasting requesting an interview regarding Leonard Peltier’s pending clemency petition.

Several emails were exchanged providing Peltier background and answering some questions. A date was arranged and there were no qualifications or restrictions on the questions to be asked by the reporter. The reporter advised that he had already interviewed Peltier’s attorney(s).

What follows is the transcript of Ed Woods’ portion of the interview (Part 1). Part 2, responding to the comments made by Peltier’s attorney(s), will be the subject of a subsequent blog.

* * *

Interviewer: Can you give me your name again, title in relation to the Leonard Peltier case?

Ed Woods: It’s Ed Woods and I’m the founder and creator of the No Parole Peltier Association and the associated website that was launched on April 30, 2000.

Interviewer: And can you give me your thoughts on a potential clemency
/compassionate release, push for Mr. Peltier?

EW: Well based on the past sixteen and a half years of reviewing the Peltier matter in great detail, Leonard Peltier isn’t qualified for any compassion under the President’s current program and I agree with the President’s program that the war on drugs and the sentencing guidelines back in the eighty’s were very extreme, so I recognize that. His program does not include cold-blooded convicted murderers, unrepentant convicted murderers, for commutation.

As far as a compassionate release because of his health, I’d say that I would be 100% accurate thinking that Jack Coler and Ron Williams wouldn’t mind being seventy years old today and facing whatever life brings them in terms of health, and of course, being robbed of the opportunity to spend the rest of their lives with their family and grandchildren. So, from the health perspective that’s just a matter of the aging process, and whether Leonard Peltier was in USP Coleman or out in the street. If you read his book he wanted to become an artist and he’s been doing that in prison. Maybe he would have been successful doing something else, but the fact of the matter remains that we all get old, we all have to face those issues. He has to face them where he is.

Interviewer: The last time this sort of came up was during the Clinton administration and 500 FBI agents marched around the White House, as that was being contemplated do you foresee anything like this happening if Obama would consider a Peltier release?

EW: Quite frankly, as a matter of fact it was closer to 700 agents and I was there that day, December 15, 2000, and it wasn’t a march around the White House. We gathered at the law enforcement memorial, we had a collective prayer, we read the names of those who were killed in the line of duty and it was a very dignified. I wouldn’t call it a march, a procession to the White House to express our collective request of the President that he not consider clemency or commutation for Peltier. And the president of the FBI Agent’s Association was allowed into the White House, and gave them well over 10,000 signed petitions. Now, to answer your question, no, I don’t believe there would be another gathering like that this time.

Interviewer: Certainly, certainly, I have one more question, just based on a lot of things I’ve heard, I’ve been down to Pine Ridge and stuff like that, Amnesty International has called Leonard Peltier a political prisoner, I think various other groups have as well, and they say he’s been in prison for longer than Nelson Mandela, and that he should be let go, and that he is no longer a harm to society and that sort of thing. Could you, could you, respond to some of those statements that people are saying around here?

EW: Well, they’re entitled to their, their opinions obviously, but, and I’ve been through this many times, I would throw back, or offer back to them, look at the record. Look at what’s happened. I’ve read every word of testimony, all the appeals. If a man was truly innocent, he’s not a political prisoner. He was captured and convicted, went through dozens of appeals for the cold-blooded murder of two already wounded FBI agents. So, they’re entitled to their opinion. Peltier isn’t a political prisoner, although that’s the route that he’s gone down and quite frankly that’s his only defense. And a truly innocent person wouldn’t change his story about what happened that day a half a dozen times. He wouldn’t also, for the better part of twenty years, claim his only alibi was Mr. X. That somebody else who was delivering dynamite to the AIM camp that day, was followed by the agents, shot the agents, killed them and drove off. That was proven to be a lie, and yet, if you look at Redford’s movie where Robert Robideau goes on for six and half minutes and describes this elaborate chase and the shooting, and Mr. X drives off into the distance. And in the very next frame, Leonard Peltier says, “This story is true.” Well, it wasn’t true and we know it wasn’t true because Dino Butler, one of the other AIM members, came out publicly in 1995, I believe, and said it was a lie.

So there’s no politics involved here. It was a straight up criminal conviction of somebody who, I wouldn’t call it an ambush; I think Peltier just over-reacted because he knew he was wanted for the attempted murder of a Milwaukee police officer and at that moment probably felt, and he shouldn’t have, that the agents were coming for him when they were actually looking for Jimmy Eagle. So, and then you come down to the final part of that, you have two wounded agents, and the final killing shots, I would say, I would almost call that an assassination. I’ve taken the position that maybe in Peltier’s mind, maybe he panicked, I don’t know, but certainly he may have thought that dead men make poor witnesses.

And to go back to the actual events of that day, we know what happened. There was no, there was no secret because there was an eye witness that was telling everybody on the radio, that was Ron Williams, exactly what was about to happen before any of the shooting started. And I’ve been through Peltier’s 44 page petition for clemency and I’m still shocked to this day that Martin Garbus, Cynthia Dunne and Carl Nadler would actually put this stuff in writing, things that have been totally disproven over the years. So I know that’s a long answer to your question, but no, this is a criminal case. Peltier was—even Judge Heaney, said that Peltier got a fair trial, not a perfect trial, because those kinds of trials are very difficult, you don’t have DNA evidence, you don’t have video, but even Judge Heaney said—and Judge Heaney never even implied for a moment that Peltier was innocent in that letter. But he did in that 60-Minutes interview say that Peltier got a fair trial, not a perfect trial, but a fair trial. And he’s where he belongs.

From where I stand, Peltier should finish out the remainder of his two consecutive life sentences, which, if you go back historically, were averaging 30 years each, plus the seven consecutive years he got for the armed escape from Lompoc Penitentiary where guards were shot at. So, there was no politics involved here, it’s a straight adulteration of an otherwise proud Native culture where Leonard Peltier and the American Indian Movement did absolutely nothing to help their own people.

Interviewer: Ed, thank you very much for answering my questions. And I know you’re really busy, but I did, I was wondering out of curiosity what got you involved in this, on the Peltier case?

EW: There is only one place on the website that I talk about myself and it’s an editorial essay called Pilgrimage to Pine Ridge and I just give my background and what prompted this was I just coincidentally met Jack Coler’s youngest son. Jack had two sons when he was murdered, one was three the other was one and a half. And in—on April 1st 2000, I just happened to meet Jack Coler’s youngest son.[i] And based on that meeting I did a search of the Internet that night, saw what was out there, and quite frankly—and I was in the FBI for 29 years, and I had no idea the kind of stuff that was out there. I read through it all, I downloaded every page in the Leonard Peltier Defense Committee website. I read it, they said “read the book,” I mean, “watch the film” Incident at Oglala, I rented it; they said “read the book,” In the Spirit of Crazy Horse, by Peter Matthiessen, I also got Peltier’s book, Prison Writings, and I went through all of it. And as I went through it I saw all the lies, the myths and the folklore that have been following Peltier and that’s what prompted me launching, 27 days, 29 days later, the website.

Interviewer: Very nice. Well, I don’t want to keep you or anything, and I wish you a happy retirement.

EW: All right, thank you, and best for the holidays and if you have any other follow-up please don’t hesitate to contact me.

Interviewer: That email would be the best?

EW: Yes.

Interviewer: OK, perfect, thank you very much.

EW: Have a good day.

Interviewer: OK, you too.

EW: Bye.

Interviewer: Bye.

Re: E.O. Violation
International Leonard Peltier Defense Committee (ILPDC)
P.O. Box 24, Hillsboro, OR 97123

Dear E.O. Director:

Please find attached IRS complaint form #13909 to bring to your attention—once again, that Leonard Peltier is engaging in deceptive practices and violating Exempt Organizations regulations involving fraudulent, allegedly “tax deductible” activities.

Please reference my many previous communications dating back to August 2000 (former reference number 4426 12-2009) regarding Leonard Peltier’s and the ILPDC’s efforts to circumvent IRS laws.

Leonard Peltier is serving consecutive life sentences for the brutal murder of two FBI agents in 1975, had undergone over a dozen appeals and his conviction and sentence has never been altered.

Prior complaints to your office have likely resulted in actions against Peltier’s fraudulent fund raising activities, because they have, several times, removed references to “tax- deductible donations,” however, Peltier has systematically reverted to repeated similar tactics, again, as in this instance.

The ILPDC states publicly:

“Please make a tax deductible donation of $5.00 (or more) at (website[i]). If you prefer, send a check or money order made payable to the ILPDC to PO Box 24, Hillsboro, OR 97123.”

The below footnoted website states:

“Please make a tax-deductible donation. No amount is too small…The ILPDC is a project of the Indigenous Rights Center, a 501(c)(3) tax exempt organization.”

The ‘director’ information for the Indigenous Rights Center, 202 Harvard Dr., SE #5, Albuquerque, NM, 87114 reveals the following:

Delaney Bruce, Peter Clark, Kari A. Boushee and Chauncey Peltier.
Bruce, Clark and Boushee are longtime Peltier supporters, and Chauncey Peltier is Leonard Peltier’s son.

Essentially the same people who operate the ILPDC are operating the Indigenous Rights Center under the guise of a “project,” when in fact it is a mechanism to raise money on behalf, and for the benefit of, a convicted felon by deceiving people into believing their donations are indeed, tax deductible.

The Indigenous Rights center displayed the following copyright, which clearly linked the two organizations and Leonard Peltier:

©2016 ILPDC/Indigenous Rights Center LLC, 202 Harvard SE, Albuquerque, NM 87106[ii]

IRS regulations are very clear concerning tax-deductible donations;

“A section 501(c)(3) must not be organized or operated for the benefit of private interests, such as the creator or the creator’s family, shareholders of the organization, other designated individuals, or persons controlled directly or indirectly by such private interests. No part of the net earnings of the section 501(c)(3) organization may inure to the benefit of any private shareholder or individual. A private shareholder or individual is a person having a personal and private interest in the activities of the organization.”

Clearly, the directors of the Indigenous Rights Center (IRC), that include a family member, Chauncey Peltier and Leonard Peltier himself, have a vested personal and private interest in raising money by any means necessary by burying the reality of their claims to unsuspecting donors through deceptive layering of their fund raising.

The unrepentant, convicted double-murderer, Leonard Peltier, is not a charity case and it is evident that the IRC, its directors, including a Peltier family member, are once again, circumventing the law.

Sincerely,
Edw. Woods
